The petitioner seeks regular bail in connection with Bhadaur P.S. Case No. 26 of 2005 for the offence registered under Section 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that three persons are named in the First Information Report. The allegation against all the three accused persons is to kill Umesh Mahto. Patna High Court Cr.Misc. No.1553 of 2015 (2) dt.16-01-2015 2/2 Mahto @ Surendra Mahto and Kara Dhanuk @ Arbind Dhanuk have already been acquitted by judgement and order dated 25th of May, 2012 passed in Sessions Trial No. 135 of 2007. It appears that the case is of the year 2005 and the petitioner had been absconding. The trial has already begun. Considering the facts that the petitioner was absconding since long, I am not inclined to grant bail to the petitioner. Accordingly, the same is rejected. However, the Trial Court is directed to expedite and conclude the trial of the petitioner within a period of six months from the date of receipt of this order. If the trial is not concluded within the aforesaid period, the petitioner may renew his prayer for bail firstly in the Trial Court.
