The petitioner is in custody since 30.07.2019 in connection with Excise Case No. 270/2018 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were made not from the conscious possession of the petitioner, but from a Hut which does not belong to the petitioner.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of
