JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 This is an application for grant of anticipatory bail in connection with Behea P. S. Case No. 163 of 2019, disclosing offences under Sections 341, 323, 307, 504, 34 of the Indian Penal Code.
As per F.I.R. five accused persons including the petitioners assaulted the informant by lathi and danda, causing injury.
Submission of the learned counsel for the petitioners is that as a matter of fact, there was some altercation between the children of both the parties and due to that some scuffle took place between them. The injuries are simple in nature. There is no intention to kill anybody.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M. Bhojpur at Ara, in connection with Behea P. S. Case No. 163 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
