1. Heard Mr. Umesh Prasad, learned counsel for the petitioner and Ms. Sangeeta Sharma, learned APP for the State.

2. The petitioner seeks regular bail in connection with Kajra P. S. Case No. 91 of 2025, dated 19.07.2025 registered for the offences punishable under Sections 126(2), 115(2), 351, 352, 109(1) and 3(5) of the B.N.S.

3. The main submissions advanced by the petitioner's counsel are that there is a case and counter case in between both the parties, in fact, petitioner, his mother and father were brutally assaulted by the informant and his sons resulting in injuries to them, for which Kajra P.S. Case No. 92 of 2025 was lodged by them and copy of the said FIR has been filed with this petition as Annexure- P/2. It is further submitted that in the

No.64208 of 2025(2) dt.10-09-2025 2/2 FIR there is no serious allegation against this petitioner and the main allegation is against the co-accused Sarita Devi, who happens to be the mother of this petitioner. It is lastly submitted that the petitioner has been languishing in jail since 20.07.2025 and bears no criminal antecedent.

4. Though, the learned APP appearing for the State has opposed the bail prayer of the petitioner but submits that the alleged incident may be result of a free fight in between both the parties.

Considering the aforesaid submissions advanced by the petitioner's counsel and mainly taking into account the nature of the allegation appearing against this petitioner and coupled with his fair and clean antecedent, this court is inclined to release him on bail. Accordingly, let the petitioner namedabove be enlarged on bail in connection with Kajra P. S. Case No. 91 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
