JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-11-2017 The petitioner seeks regular bail in connection with Maranchi P.S. Case No. 29 of 2017, registered for offences punishable under Sections 20/22 of NDPS Act. Allegation is of recovery of 48 KG of ganja from a Bolero vehicle and petitioner and one co-accused was arrested from there.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and petitioner was only the passenger of the vehicle from which alleged recovery was made. Further petitioner has no criminal antecedent and has been in custody since 07.04.2017.
Heard learned A.P.P. also.
Having heard both sides, considering the fact and
Patna High Court Cr.Misc. No.54792 of 2017 (2) dt.17-11-2017 circumstances of the case and also the fact that in this case huge quantity of ganja has been recovered, as such, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
