The petitioners seek bail in Sasaram Model P.S. Case No.138 of 2017 registered under Sections 379 of the Indian Penal Code.
As per the prosecution case, motorcycle of the informant is said to have been stolen by unknown miscreants parked outside the Sasaram Civil Court.
It is submitted by learned counsel for the petitioners that the petitioners are neither named in the F.I.R. nor they were apprehended on the spot. They were apprehended with the aforesaid motorcycle regarding which Ara Nawada P.S. Case No.86 of 2017 under Section 414/34 of the Indian Penal Code has
Patna High Court Cr.Misc. No.50277 of 2017 (02) dt.17-10-2017 2/ 2 been lodged and they have been enlarged on bail by this Court in the said case. For the same offence two cases are not maintainable. The petitioners have been remanded in this case from the said case on 22.08.2017.
Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram Model P.S. Case No.138 of 2017.
