Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406, 408, 420, 120B of the I.P.C.
It is alleged that petitioners being labourers received payment twice for the one and same working day
Patna High Court Cr.Misc. No.7231 of 2015 (2) dt.03-03-2015 2/2 under Pulse Polio and MANREGA schemes during the year 2007-08.
It is submitted by learned counsel for the petitioners that petitioners never received the money. Moreover for the payment made in the year 2007-08 the First Information Report was registered in 2011 after due enquiry when petitioners were not named in the First Information Report but ultimately the cognizance has also been taken against the petitioners as their names sprang up during investigation. A statement has been made in para 3 of both the petitions that petitioners have no criminal antecedent. Considering the delayed lodging of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Katra P.S. Case No. 125 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
