The petitioner seeks bail in a case registered under Sections 363, 366(A) of the Indian Penal Code. Allegation is that unknown person has kidnapped the daughter of the informnat.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.7.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has come in course of investigation. A petition has been filed on behalf of the victim in the court below, which is Annexure 4 to the present application, where the victim has admitted that she has married
Patna High Court CR. MISC. No.58940 of 2019(2) dt.19-09-2019 2/2 to the petitioner and she is carrying pregnancy of three months. She is staying in the house of this petitioner and her statement under Section 161 of Cr.P.C. has been recorded under due influence of her parents. Vide Annexure 5 to the present application, the matter has been compromised. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IInd, Jhanjharpur, District Madhubani in connection with Phulparas P.S. case No.284 of 2018 (G.R. No.1631 of 2018). (Sudhir Singh, J) Narendra/- U T
