Petitioners seek bail in connection with Bhabua P.S. case no. 346 of 2017, registered under Sections 302 and 307/34 of the IPC and Section 27 of the Arms Act.

Both the petitioners are not the assailants of the deceased but on going through the First Information Report, it appears that they actively participated in the offence. They are stated to be in custody since 19.07.2017. Counsel for the petitioners stated that they do not have criminal antecedents which has been disputed by the counsel for the informant. Considering the nature of the allegation, the Court is not inclined to direct their release on bail. Prayer for bail is ,

Patna High Court Cr.Misc. No.50963 of 2017(2) dt.09-11-2017 2/2 accordingly, rejected.

Petitioners are at liberty to renew prayer for bail in the Court below after the charges are framed. If any such application is filed, the same shall be considered and disposed of unprejudiced by the present order.
