The petitioner is apprehending his arrest in a complaint case wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Section 420/34 of the Indian Penal Code.

It is alleged that the petitioner and one co-accused Lal Babu Singh took Rs. 50,000/- from the complainant for providing employment in railway. Subsequently, the petitioner issued a cheque of Rs. 50,000/- but the same got bounced.

It is submitted by learned counsel for the petitioner that the cognizance has not been taken under Section 138 of N.I. Act and there is no proof with regard to payment. A statement has been made in

Patna High Court Cr.Misc. No.12687 of 2015 (2) dt.26-03-2015 2 / 2 paragraph no. 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute good grounds for consideration of prayer for regular bail of the petitioner if he surrenders within a period of six weeks from the date of receipt/production of copy of the order in connection with Sessions Trial no. 657 of 2015, arising out of Complaint Case No. 24 of 2009, pending in the court of the learned J.M. Ist Class, Jehanabad.

With this observation, the application is disposed off.
