The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 362 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Excise Prohibition and Excise Act, 2018.
Learned counsel for the petitioner submits that there is recovery of 507.375 liters of Indian made foreign liquor from the Varanda of the co-accused Navin Yadav. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner. Learned counsel for the petitioner further submits that earlier two cases are pending against the petitioner in similar nature.

No.60972 of 2019(3) dt.28-11-2019 2/2 In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs.25,000/- in the court below/ Nazarat and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II cum Special Judge, Begusarai in connection with Muffasil P.S. Case No. 362 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
Such deposit of Rs.25,000/- shall abide by the outcome of the criminal case.
