JUSTICE SANDEEP KUMAR ORAL ORDER 01-11-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Khagaria P.S.Case No. 679 of 2023 for the offence punishable under Section 8(c), 20, 29 of N.D.P.S. Act.

It is alleged that petitioner has been named as involved in business of Narcotic substance and total 195.002 Kg Ganja was seized.

Learned cousnel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. It is further submits that on the basis of confessional statement of son of Shanker Yadav, huge quantity of Ganja was recovered from the house of Shankar Yadav. Petitioner is in jail custody since 07.07.2023.

Patna High Court CR. MISC. No.69510 of 2023(2) dt.01-11-2023 2/2 Learned APP has vehemently opposed the prayer of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge Khagaria, in connection with Khagaria( Muffasil) P.S. Case No. 679 of 2023.

The petitioner will visit Khagaria police station on the first and third Sunday of each month. Any default in appearance at the police station would be result in cancellation of bail bond of the petitioner.
