Subsequently Section 395 of the I.P.C was also added.

The accusation is of committing dacoity in the house of the informant. The name of the petitioner sprang up during investigation as a person who was roaming around the house of the informant 4-5 days prior to the occurrence. It is submitted by learned counsel for the petitioner that neither any recovery has been made from the petitioner nor the petitioner has been put on test identification parade. A statement to that effect has been made in para 8 of the petition. Moreover the investigation has already concluded.
