The petitioner is accused in connection with Forbesganj P.S. Case No. 98 of 2008 registered under Sections 302 and 201/34 of the Indian Penal Code.
The accusation is of killing the daughter of informant by her husband and in-laws after ten years of the marriage and her dead body was traceless.
Learned counsel for the petitioner submits that petitioner is the brother-in-law of the daughter of the informant, who is said to be killed and has falsely been implicated in this case. It is further submitted that similarly situated co-accused,
Patna High Court Cr.Misc. No.7573 of 2015 (2) dt.10-04-2015 Khalil Ansari, who is also the brother-in-law of the daughter of informant, has already been granted privilege of bail by a Bench of this Court vide order dated 08.05.2013 passed in Criminal Misc. No. 15258 of 2013. It is further submitted that petitioner has no criminal antecedent and he is in custody since 06.01.2014. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No. 98 of 2008.
