JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Bhargama P.S. Case No. 136 of 2017 registered for the offence punishable under sections 406, 420, 467, 468, 471 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the present first information report has been lodged only because on the alleged date of occurrence petitioner was posted as Panchayat Sachiv of the concerned Panchayat. However, in response to the explanation sought for by the Block Development Officer, Bhargama, petitioner submitted his explanation denying his writing and signature in the death certificate in question vide Annexure-2. Patna High Court Cr.Misc. No.53557 of 2017(3) dt.18-12-2017 2/2 from service on 30.06.2012. He has no criminal antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Bhargama P.S.
