JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 08.01.2014 in a case registered for the offences punishable under Sections 395 and 328 of the Indian Penal Code.
The accusation is of robbing the truck loaded with fish after injecting some intoxicant to the driver and cleaner. Name of the petitioner sprang up on the confession of co-accused Ripu Shrivastava.
It is submitted by learned counsel for the petitioner that no recovery has been made from the petitioner and co-accused Ripu Shrivastava has been granted regular bail by this Court vide Cr. Misc. No. 772 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/-
Patna High Court Cr.Misc. No.11085 of 2015 (2) dt.24-03-2015 2/2 (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, 1st Class, Sadar at Motihari in connection with Kesariya P.S. Case No. 189 of 2013. Since the petitioner has serious criminal antecedent, learned court below will be at liberty to cancel the bail bonds of the petitioner if he default for two consecutive occasions or gets involved in some serious nature of offence.
