The petitioner seeks bail in Araria P.S. Case No.843 of 2017 registered under Sections 461 and 379 of the Indian Penal Code and later on Section 414 of the IPC was added. As per the prosecution case, three laptops, charger and hard disk are said to have been stolen from the Sub-divisional Election Office, Araria by some unknown miscreants. It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor he was apprehended on the spot. There is nothing on record indicating the complicity of the petitioner except the confessional statement of co-accused Santosh Mallick from whose possession stolen articles were recovered. Santosh Mallik has been granted bail by a

Patna High Court Cr.Misc. No.50501 of 2017 (02) dt.18-10-2017 2/ 2 co-ordinate Bench of this Court in Cr. Misc. No.22394 of 2017 vide order dated 21.06.2017. The petitioner has been languishing in custody since 02.03.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Araria in connection with Araria P.S. Case No.843 of 2016.
