2. The petitioners have prayed for regular bail in a case instituted for the offence under Sections 153, 153-A(1)(a),

Patna High Court CR. MISC. No.66931 of 2023(4) dt.08-12-2023 2/3 153-A(1)(b), 153-A(1)(c), 297, 505(1)(b), 505(1)(c), 120B of the Indian Penal Code and Sections 66, 66-F of the Information Technology Act.

3. As per prosecution case, on the occasion of Ram Navmi, law and order of Bihar Sharif town was disturbed by some miscreants including the petitioners. Petitioners have posted some communal message on different social media.

4. It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case due to dirty village politics. They have committed no offence. There is general and omnibus allegation against the petitioners rather the name of these petitioners transpired on the basis of suspicion that they were only member in the WhatsApp Group namely "Bajrang Dal Nalanda". Petitioners have no concern with the alleged communal riot. Save and except group chatting, nothing has been come against these petitioners. He further submitted that the other co-accused has already been granted bail by this Bench vide order dated 05.09.2023 passed in Cr. Misc. No. 56302 of 2023. They are languishing in judicial custody since 10.04.2023.

5. The application for bail is opposed by learned APP for the State and learned counsel for the E.O.U.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned 1st Additional Chief Judicial Magistrate, Patna in connection with Economic Offence, Bihar P.S. Case No. 07 of 2023.
