JUSTICE NANI TAGIA ORAL ORDER 23-09-2025 Heard Mr. Mrityunjay Kumar, learned counsel for the petitioner and Mr. Sanjay Pandey, learned counsel for the Bihar Public Service Commission.

2. The writ petition has been filed by the petitioner to declare the petitioner successful against the vacant and sanctioned post of Head Master of Government Higher/Senior Secondary School, reserved for Economically Weaker Section (EWS) category, for which selection was made under

Patna High Court CWJC No.15534 of 2025(2) dt.23-09-2025 2/3 Advertisement No. 26/2024 dated 01.03.2024 by the Bihar Public Service Commission.

3. It is contended by the learned counsel for the petitioner that altogether 576 posts of Head Master was advertised vide advertisement No. 26/2024 for Economically Weaker Section category candidates.

4. The writ petition does not disclose as to how many candidates for the post of Head Master under EWS category have been selected pursuant to the Advertisement No. 26/2024.

5. The petitioner has also not disclosed in the writ petition that the petitioner has scored higher marks than any of the candidates selected by the Bihar Public Service Commission under EWS category.

6. On the other hand learned counsel representing the Bihar Public Service Commission has submitted that 576 candidates, as advertised, have been provisionally selected and recommended for appointment by the State Government.

In that view of the matter, since the petitioner in the writ petition has neither enclosed the result published by the Bihar Public Service Commission pursuant to Advertisement No. 26/2024 regarding the selection made for the post of Head Master for Economically Weaker Section candidates to indicate

Patna High Court CWJC No.15534 of 2025(2) dt.23-09-2025 3/3 as to how many candidates have been selected by the Bihar Public Service Commission and also in view of the fact that the petitioner has not disclosed or stated that he has scored higher than any of the selected candidates by the Bihar Public Service Commission, I find that the writ petition does not disclose any cause of action for issuance of notice to the respondents.

8. Accordingly, the writ petition is dismissed in limine.
