The petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code.

The informant named thirteen persons and alleged that Amlesh Yadav fired which hit his son Birendra Yadav on his neck and Birendra Yadav died. Rajendra Goswani is alleged to have assaulted Bilas Yadav with Dabiya (sharp edge weapon).

Learned counsel for the petitioner submits that there is no allegation of assault against the petitioner and co-accused Sarun Yadav @ Sarun Pd. Yadav has already been enlarged on bail vide Cri. Misc. No. 165 of

Patna High Court Cr.Misc. No.2876 of 2015 (2) dt.22-01-2015 2/2 2015.

Considering the fact that there is no allegation of assault against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri Sunil Kumar, J.M. Ist Class, Katihar in Falka (Pothiya) P.S. Case No. 251 of 2014.
