The petitioner seeks bail in connection with Tekari P. S. Case No. 62 of 2016 registered under Section 7 of the Essential Commodities Act.
It is contended by learned counsel for the petitioner that though the inspection was carried out in the PDS shop of the petitioner on 10.01.2016, the FIR was registered after undue delay on 17.02.2016 and there is no explanation for the delay caused in the institution of the FIR. It is further contended that the petitioner is an old man aged about 70 years and is in custody since 18.03.2016.
Regard being had to the facts and circumstances of
Patna High Court Cr.Misc. No.21818 of 2016 (2) dt.20-05-2016 2/2 the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned SDJM, Gaya in Tekari P. S. Case No. 62 of 2016.
