This is an application for bail in connection with Arwal P.S.Case No. 155 of 2017 registered for the offences punishable under Section 414 of the Indian Penal Code.

Allegation against the petitioner is of recovery of one stolen motorcycle from his possession.

Submission of learned counsel for the petitioner is no such recovery has been made from the petitioner and he is in custody for three months, having no criminal antecedent. Further submission is that he has been implicated in this case at the instance of co-accused and one co-accused from whose possession Bolero vehicle was recovered has been granted bail by court below itself.

Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal, in connection with Arwal P.S.Case No. 155 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court, failing which his bail bond shall be cancelled.
