JUSTICE SANJAY PRIYA ORAL ORDER 25-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Buddha Colony P.S. Case No. 143 of 2015 instituted for the offence under Section-363A of the Indian Penal Code.

As per written report, eight years old daughter of the informant had gone to market with her brother Raja and she did not return back. She was seen at Patna Junction along with one woman beggar.

The statement of victim girl has been recorded u/S 164 Cr.P.C. in which, she has stated that near Taramandal, this petitioner along with Asha Devi took her on tempo to their house and they used to take domestic work from her. They also caused injury to her by assault of knife as mentioned in her statement u/S 164 Cr.P.C.

Patna High Court Cr.Misc. No.51696 of 2017 (4) dt.25-01-2018 2/2 Therefore, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.

The petitioner is directed to surrender in the court below and seek regular bail which will be considered and disposed of on its own merit in accordance with law without being prejudiced by this order.
