JUSTICE RAKESH KUMAR ORAL ORDER 03-03-2016 Heard Sri Rajani Ranjan Prasad Singh, learned counsel for the petitioner, Sri Jharkhandi Upadhyaya, learned A.P.P. as well as Sri Madanjeet Kumar, learned counsel, who has voluntarily appeared on behalf of the informant. In the present petition the petitioner has prayed for quashing of the order of cognizance dated 9.1.2013 passed by learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara town P.S. Case No. 81 of 2010. By the said order the learned Magistrate has taken cognizance of offence under Section 302, 120(B)/ 34 of the Indian Penal Code.

At the very outset, Sri Madanjeet Kumar, learned counsel the informant submits that after the order of cognizance many subsequent developments have taken place in the case. He

Patna High Court Cr.Misc. No.21011 of 2013 (3) dt.03-03-2016 2/2 submits that the case was subsequently committed to the court of sessions. After framing of charge, trial has already commenced. After noticing the fact that trial has already commenced, learned counsel for the petitioner seeks permission to withdraw the petition.

The prayer is allowed.

The petition stands dismissed as withdrawn.
