The petitioners of both the aforesaid applications are in custody since 11.10.2014 in connection with Dhaka P.S. Case No. 172 of 2014 for the offence registered under Sections 302, 201, 120B, 379/34 of the Indian Penal Code and Section 27 of the Arms Act.

No.19066 of 2015 (2) dt.28-07-2015 Learned counsel for the petitioners submits that petitioners have been named in the first information report stating that it was these petitioners who went with the father of the informant and subsequently, the dead body of the father of the informant was recovered from the paddy field, sown in the eastern side of the school. It is further submitted that merely because of dispute between Abhishek Kumar and the deceased with regard to some committee funds, the said Abhishek Kumar has made confession before the police with regard to the involvement of the petitioners, the petitioners are being prosecuted needlessly.
It is further submitted that the statement, made before the police particularly, in the form of confession implicating others is not permissible in law and therefore, the same should be ignored. Considering the aforementioned submissions as also the fact that petitioner has no criminal antecedent, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand)each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sikrahana at Motihari in connection with Dhaka P.S. Case No. 172 of 2014.
