ANJANA MISHRA ORAL ORDER 17-05-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Motihari Mahila P.S. Case No.82 of 2015 for allegedly having committed the offence under Sections 341, 323, 376 of the Indian Penal Code and Sections 3, 4, 6 of the Protection of Children from Sexual Offences Act, 2012, which is pending in the court of the learned 1st Additional Sessions Judge-cum-Special Judge, Special Court under POCSO Act, East Champaran at Motihari.
Case diary in the present case was called for, which has since been received.
After consideration of all aspects of the matter, the
Patna High Court Cr.Misc. No.1079 of 2016 (4) dt.17-05-2016 2/2 statement of the victim girl made under Section 164 Cr. P.C. and also other materials which have surfaced in the case diary, I am not inclined to grant anticipatory bail to the petitioner. It is, accordingly, dismissed.
