2. The petitioner seeks bail in connection with Sitamarhi P.S. Case No. 439 of 2025 registered for the offence under Sections 109(1), 3(5), of the BNS and under Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner and others are said to have fired upon the victim.

4. The petitioner is in custody since 17.06.2025.

5. Learned counsel for the petitioner submits that the petitioner is innocent and the specific allegation of firing is against one Sunil Rai.

6. Considering the fact that there is no specific allegation against the petitioner of having fired at the victim, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi/concerned Court below in connection with Sitamarhi P.S. Case No. 439 of 2025, subject to the condition that both the bailors should be close relative of the petitioner.

8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Punaura Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U
