Three petitioners, who were named specifically as accused in the F.I.R. i.e. Keshariya P.S. Case no.7 of 2014, which was registered long back on 09.01.2014 for the offence under Sections 363, 366A/34 of the Indian Penal Code, have prayed for grant of anticipatory bail.
In the case, a minor daughter of the informant was kidnapped and, thereafter, the informant has disclosed the name of accused persons, which includes the name of three petitioners. Learned counsel for the petitioners submits that during
Patna High Court Cr.Misc. No.5798 of 2016 (2) dt.22-02-2016 2/2 investigation, the case was found true against one of the accused persons, namely, Jaishyam Kumar and, as such, he submits that it is a fit case for extending the privilege of anticipatory bail. On perusal of the impugned order, it is evident that the victim girl was not recovered till 06.11.2015. In view of facts and circumstances, I do not find any ground for extending the privilege of anticipatory bail.
The petition stands dismissed.
