The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 145, 146, 153, 174(A) of the Railway Act and Section 3 of RP(UP) Act.

The prosecution case as per F.I.R is that 500 unknown persons reached at the platform of Lakhisarai Railway Station in the protest of Agnipath Yojna New Recruitment Rules of Army and further other 500 unknown boys also reached there and pelted stones on the train and set the railway coach on fire, as a result of

Patna High Court CR. MISC. No.68092 of 2023(3) dt.05-01-2024 2/3 which, 21 coaches and luggage of the passengers got burnt and a passenger also died due to suffocation. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner was not present at the time of occurrence and there is nothing on record to suggest that petitioner incited violence. The petitioner is languishing in custody since 26.04.2023.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul, Lakhisarai in connection with RPF Kiul
