ANSHUMAN ORAL ORDER 25-03-2023 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in connection with Roh P.S. Case No. 217 of 2022 lodged under Sections 307, 341, 323, 379, 504 and 506/34 of the Indian Penal Code. As per the first information report the named three accused persons have visited the house of the informant and started to construct a house. The specific allegation against the petitioner is that he has kept one pistol and one knife. He threatened the informant and assaulted by butt on the neck as well as attacked by fists.

Counsel for the petitioner submits that there are two criminal cases pending against the petitioner in which is on bail and in custody in this case since 17.08.2022. Counsel for the State opposes the prayer for bail. Upon going through the facts and circumstances of

Patna High Court CR. MISC. No.63649 of 2022(2) dt.25-03-2023 2/2 the case, I am not inclined to grant bail to the petitioner. The prayer for bail is rejected.

The petitioner may renew his prayer for bail after two months of framing of charge and the trial Court shall release the petitioner after framing of charge on bail imposing his own condition(s) so that he may not evade his appearance during trial.
