2. The petitioner seeks bail in connection with Sessions Trial No. 117 of 2022, CIS No. 22 of 2022 arising out of Bithan P.S. Case No. 95 of 2019 dated 11.10.2019 instituted for the offences under Sections 302/394 of the Indian Penal Code and Section 27 of the Arms Act.

3. The deceased was shot dead while being robbed of his belonging.

4. The implication of the petitioner in the present case is on the basis of confessional statement of one Wakil Mukhiya, who is on inimical terms with the petitioner.

5. There is no recovery of any incriminating substance from his possession, and he is in custody since 01.12.2021.

6. Wakil Mukhiya and another co-accused persons, viz., Hasan @ Hasnain @ Md. Hasnain have been granted bail by the High Court.

7. The learned Advocate for the petitioner has further informed this Court that up till now, only one witness has been examined in the Trial.

8. Considering the afore-noted facts, the petitioner, named above, is directed to be released on bail on furnishing his bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each
