Learned counsel for the private respondents as well as learned SC-19 for the State is present.
Patna High Court CWJC No.20 of 2013 (9) dt.01-03-2017 2/2 The record of the case goes to show that on 22.02.2017, this matter was listed but on that date also, petitioners failed to appear before this Court. However, learned counsel appearing for the private respondents points out that this writ petition is not maintainable in view of Section 9 of Bihar Land Tribunal Act and similar nature of dispute of the parties was raised in CWJC No. 23863 of 2012, which was, subsequently, withdrawn by the petitioners with liberty to approach the Bihar Land Tribunal, Patna.
Since no one appeared on behalf of the petitioners to controvert the aforesaid submission, I do not think it proper to give finding on the above stated issue, as raised by the learned counsel for the private respondents, and, therefore, this petition stands dismissed for default.
