The sole petitioner, who is in custody in connection with Bihar P.S. Case no.386 of 2015 registered for the offence under Section 392 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that though the petitioner is having criminal antecedent and he has been remanded in the present case from another case, F.I.R. was lodged against unknown persons and during investigation, on the basis of confessional statement the petitioner
Patna High Court Cr.Misc. No.26656 of 2016 (2) dt.11-07-2016 2/2 has been made accused in the present case. By way of referring to Annexures 2 and 3, he submits that other two accused, from whose possession some recovery was affected, have already been granted bail by the court below.
Keeping in view fact that the petitioner has been made accused on the basis of confession as well as the fact that other two co-accused persons have been granted bail by the court below itself, there is no reason to further detain the petitioner. Let the petitioner, namely, Md. Sonu @ Md. Zafar @ Sonu be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S.
