The petitioners are languishing in custody since 13.03.2015 and 21.03.2015 respectively in connection with Gaurichak P.S. Case No. 39 of 2015 for the offences instituted

Patna High Court Cr.Misc. No.25919 of 2015 (3) dt.02-09-2015 2/3 under Section 364/34 of the I.P.C.

The prosecution story, in brief, is that on 04.03.2015 at about 9.15 P.M., in the night while the informant alongwith his son was returning from his egg shop towards his house, then on the way some unknown miscreants intercepted his motorcycle and having placed pistol upon him prevented them to raise alarm. It is further submitted that a person, came from behind, lifted away the son of the informant, namely, Vikash Kumar, aged about 8 years and fled away with him. The person, who placed the pistol upon the informant, he too took his heals towards Fatehpur. It has been submitted on behalf of the petitioners that the petitioners are in custody since 13.03.2015 and 21.03.2015 respectively and the charge sheet has been submitted in the present case. Petitioners have got no criminal antecedent. The victim boy has been examined under Section 164 Cr. P.C. and the petitioners are not named in the said statement of the victim boy. Other coaccused has been granted bail by this Court vide Cr. Misc. No. 35556 of 2015.

On behalf of the State it has been submitted that the petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.25919 of 2015 (3) dt.02-09-2015 3/3 bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Patna city, Patna, in connection with Gaurichak P.S. Case No. 39 of 2015.
