In this case the petitioner is seeking bail in connection with Dumra P.S. Case No. 118 of 2013 registered under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The F.I.R. named accused Raj Kumar Jha and others have killed the victim. The name of the petitioner has surfaced after two years in the confessional statement of Ramjee Rai and Ramjee Rai has already been granted bail vide Cr. Misc. No. 8797 of 2015 including the F.I.R. named accused, namely, Raj Kumar Jha who has been granted bail vide Cr. Misc. No. 33940 of 2013. In the facts and circumstances of the case, let the

No.21245 of 2015 (2) dt.18-06-2015 2 / 2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 118 of 2013, subject to the conditions that (i) one of the bailors will be a close relative of the petitioner, (ii) if the petitioner would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds and (iii) that the petitioner would co-operate and if the petitioner will fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
