JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-08-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, a Nokia cell phone was recovered from his conscious possession.

The contention on behalf of the petitioner is that the aforesaid seized Nokia mobile phone is not stolen property of this case nor the said cell phone was used in commission of the alleged crime. The petitioner does not have any criminal antecedent.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.28055 of 2015 (2) dt.07-08-2015 2/2 each in connection with Sursand P.S. Case No. 33 of 2015 to the satisfaction of Sri Manish Dwivedi, learned Judicial Magistrate-Ist Class, Sitamarhi.
