JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 02-11-2017 The petitioner who claims to be Mukhiya of Gram Panchayat, Dumra, Anchal-Lakadi Nabiganj in the District of Siwan has come out with a grievance that in pursuance to the scheme formulated by the State Government for awarding compensation to the victim effected by flood in the block in question, in spite of claims being submitted, the authorities, particularly the Block Agriculture
Patna High Court CWJC No.15608 of 2017 dt.02-11-2017 2/3 Officer has not taken any action and even the representation submitted before the Sub-Divisional Officer, Maharajganj and the District Magistrate, Siwan on 07.10.2017 has not been considered and as the claims of the villagers for payment of compensation due to flood is not being considered, the petitioner being Mukhiya is before this Court in the Public Interest Litigation.
Keeping in view the facts and circumstances of the case, it is the District Magistrate, in-charge of the District to look into the grievances of the villagers and ensure that the benefits accruing to the villagers out of any scheme formulated by the State Government is granted to them, in accordance to the requirement of the claim.
For the present, we deem it appropriate to direct the District Magistrate, Siwan, respondent No. 2 to look into the grievance of the petitioner and take action with regard to the distribution of the compensation in accordance to the scheme as formulated by the State Government.
Accordingly, it is directed that on petitioner filing certified copy of this order along with relevant documents for entitlement of the compensation before the District Magistrate, Siwan, he shall examine the matter, appoint appropriate officers working under him and decide the claim, in accordance with law, preferably

With the aforesaid, the application stands disposed of.
