2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 364A/34 of the Indian Penal Code.

3. As per prosecution case, the informant alleged that his son was kidnapped by miscreants who called him and demanded Rs. 30 lakhs for his son. The accused miscreants also threatened to kill his sons if their demand would not be fulfilled.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR. His name was transpired on the basis of confessional statement of other co-accused person.

No.65624 of 2023(2) dt.17-10-2023 2/2 It is further submitted that the son of the informant was recovered just one day after the alleged occurrence whose statement was recorded u/s 161 & 164 of the Cr.P.C. but he did not reveal any role of the petitioner in the alleged occurrence. Similarly situated other co-accused persons have already been granted bail by different co-ordinate Bench of the court which is annexed as Annexure-2 series. The petitioner has got no criminal antecedent and languishing in judicial custody since 19.3.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the facts and circumstances of the case as well as custody period of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kanti P.S. Case No. 201 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Muzaffarpur (West).
