JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-09-2018 The petitioner had appeared for improving his score in two subjects, namely, Physics and Mathematics of Intermediate Examination held by the Bihar School Examination Board. He has a grievance that in the revised result, which has been issued in favour of the petitioner, the marks, which was earlier allotted to him in the main examination, has been allowed to be remain intact without any alteration, which, according to the learned counsel for the petitioner, is highly improbable.

A counter affidavit has been filed on behalf of the Bihar School Examination Board stating therein that the petitioner, in the improvement examination, had scored 05

Patna High Court CWJC No.14588 of 2018(3) dt.17-09-2018 2/2 marks in Physics theory and 21 marks in one of the papers of Mathematics. It has been stated that the petitioner had although scored the same marks in Physics theory, which he had obtained there in the Intermediate Main Examination, but he secured less marks in Mathematics in the Improvement Examination compared to the main Examination and accordingly, in terms of the extant regulation, the petitioner's result has been published considering the best of the two as his admissible score, which cannot be said to be incorrect since the better marks in respect of the two Examinations taken by the petitioner has been allowed in the revised mark-sheet.

I do not find any irregularity in the decision taken by the Bihar School Examination Board. This application stands disposed of.
