The petitioner has filed the instant application praying for a direction to the respondents to appoint him on a suitable post on compassionate ground as a result of the accidental death of his father on 27.11.1996 while working as a Senior Labourer in the Hindustan Fertilizer Corporation Limited, Barauni Unit at Begusarai.

3. The case of the petitioner in brief is that his father having died on 27.11.1996, the petitioner filed an application before the General Manager of the Hindustan Fertilizer Corporation on 30.11.2000 for his appointment on compassionate ground.

It may be mentioned here that so far as appointment on compassionate ground is concerned, the same is for the purpose of the family to tide over the immediate hardship which the family finds itself in as a result of the sudden death of the sole bread earner. The same cannot be made a mode of backdoor appointment.

5. So far as the case of the petitioner is concerned, it transpires that he was aged about 9 years at the time of his father's death. Accepting that an application had been made by him, he was 13 years old at the time of his application. Further, the death having taken place on 27.11.1996 and the application having been filed for appointment in the year 2000 when the petitioner was a minor, the writ application has been filed 29 years after the death of the deceased employee.

6. In the opinion of the Court, the case of the petitioner not only does not have any merit but is an absolutely frivolous case having been filed without any explanation for the

7. The application is dismissed.
