JUSTICE SUDHIR SINGH ORAL ORDER 02-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is custody in connection with a case registered under Sections 363 and 364(A) of the Indian Penal Code.

The prosecution case, in brief, is that the informant Ashutosh Kumar s/o victim Krishna Kumar made written complaint addressed to Officer Incharge, Tariyani alleging therein that his father, Branch Manager of North Bihar Gramin Bank Branch Brindaban was as usually went at Branch on 19.03.2016 but he could not return by later night. He consulted Manoj Kumar, an Assistant of that Branch, who informed him that his father left the office at about 4.25 P.M by motorcycle. He then tried to contact with his father on mobile but switch was off. The

Patna High Court Cr.Misc. No.23291 of 2016 (4) dt.02-08-2016 2/2 informant apprehended that some unpleasant incident can be with his father.

It is submitted on behalf of the petitioner that the petitioner is in custody since 27.03.2016. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering of the witnesses against the petitioner. The petitioner is not named in the FIR. It is further submitted that the victim in his 164 Cr.P.C. statement has not named the petitioner. The petitioner has been made accused on the basis of confessional statement made before the police. On behalf of the State, it is submitted that the petitioner is not named in the FIR.

In the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheohar in connection with Tariyani P.S.Case No. 35 of 2016.
