2. The petitioner seeks bail in connection with Buxar (Town) P.S. Case No. 223 of 2023 registered for the offence under Sections 21, 22, 27 of the N.D.P.S Act.

3. Learned counsel for the petitioner submits that the petitioner is in custody since 26.04.2023 and there is recovery of nine gram of Heroin from his possession.

4. Learned APP has vehemently opposed the prayer of bail.

5. Considering the period of custody and also considering the recovery of intermittent quantity of Heroin from his possession, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with

Patna High Court CR. MISC. No.66504 of 2023(2) dt.16-10-2023 2/2 two sureties of the like amount each to the satisfaction of learned District Judge-cum-Special Court, N.D.P.S Act, Buxar in connection with Buxar (Town) P.S. Case No. 223 of 2023.

7. The petitioner will visit Buxar (Town) Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
