Admittedly the vigilance case is still pending and the S.L.P. filed against the order of the Division Bench has already been dismissed with a direction that vigilance enquiry shall be completed expeditiously and the petitioner would be at liberty to approach the High Court so that needful can be done for posting of a presiding officer. In my view, no order for payment of leave encashment amount can be passed if such inquiry or criminal proceeding is still pending.
