2. The petitioner seeks bail in connection with Paharpur P.S. Case No. 188/2022, registered for the offence under Section 302/34 of the Indian Penal Code.
3. The accused/petitioner is named in the F.I.R. and is in custody since 07.07.2025.
4. As per FIR, the sister of the informant aged about 58 years committed suicide in her matrimonial home.
5. Learned counsel appearing on behalf of the petitioner submitted that the alleged suicide committed after about 30 years of marriage, which was committed due to depression. It is pointed out that considering the overall aspect, the husband of the deceased, namely Nagendra
Patna High Court CR. MISC. No.63254 of 2025(2) dt.30-10-2025 2/3 Mishra was granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 53686 of 2025 dated 15.10.2025. While concluding the argument, it is submitted that petitioner is brother-in-law, who is living separately and having no connection with deceased and her husband. While concluding argument, it is submitted that investigation of this case is already completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence and, moreover, petitioner is a man of clean antecedent.
6. Learned APP opposed the prayer of bail.

Considering the aforesaid factual submissions and by taking note of fact as prima facie the suicide appears to be committed out of depression, where petitioner claimed to live separately with deceased and her husband, coupled with the fact that investigation of this case is already completed, where petitioner who is a man of clean antecedent remains in custody since 07.07.2025, accordingly, petitioner above named, is directed to be released on bail in connection with Paharpur P.S. Case No. 188/2022 on furnishing bail
Patna High Court CR. MISC. No.63254 of 2025(2) dt.30-10-2025 3/3 bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, East Champaran, Motihari/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
