The petitioner seeks bail in connection with Chakiya P.S. Case No. 136 of 2023 instituted for the offence under Sections 384, 387, 420, 467, 468, 471 & 120(B) of the Indian Penal Code and Section 27 of the Arms Act. 3.

The prosecution case, in brief, is that informant alleged that the accused persons, including the petitioner, forged and fabricated documents regarding his land and sold them. It is further alleged that the accused also demanded extortion money from him against the said deed and document.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12-04-2025. Petitioner

Patna High Court CR. MISC. No.63908 of 2025(2) dt.10-09-2025 2/3 bears four criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that petitioner had purchased the land in question from Suresh Sah and Bali Sah, who are heirs of the Khatiyani raiyat. It is next submitted that from perusal of the allegation as alleged in the FIR, it would also manifest that the informant admits that the sellers are heirs of Khatiyani raiyat. It is next submitted that informant has instituted Title Suit No. 810 of 2023, which is pending adjudication in the court below. Other co-accused have been granted bail by a Co-ordinate Bench of this Court vide order dated 09-09-2024, passed in Cr. Misc. No. 37191 of 2024. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and nature of accusation, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court
