Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 448, 341, 323, 504, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner is main assailant of the case. He is in custody since 25.06.2016.
Earlier prayer for bail was refused on 02.12.2016 in Cr. Misc. No. 48693 of 2016 with direction to the trial court to conclude the trial within 10 months.
Learned counsel for the informant submits that private witnesses of the occurrence have already been examined
Patna High Court Cr.Misc. No.54945 of 2017 (2) dt.31-01-2018 2/2 and only official witnesses are yet to be examined. The learned court below is directed to conclude the trial within a period of four months from the date of receipt/production of a copy of this order, failing which the petitioner, above named, would be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Paliganj Police Station Case No. 105 of 2014, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
