Petitioners apprehend their arrest in Rahui P.S. Case No.208 of 2017 for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 337 and 504 of the I.P.C. and Section 27 of Arms Act.
Counsel for the petitioners has submitted that the petitioners have clean antecedent. There is no allegation of any
Patna High Court Cr.Misc. No.54785 of 2017 (2) dt.16-11-2017 2/3 overt act against the petitioners. Injury report shows that all injuries are simple in nature. Both parties are agnates and next door neighbor It has been submitted that compromise petition has been filed.
In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Addl. C.J.M.-V, Nalanda at Biharsharif, in Rahui P.S. Case No.208 of 2017 subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with further conditions: (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable reason will automatically cancel bail bond of the petitioners and (3 ) if petitioner tampers with the evidence or the witnesses
Patna High Court Cr.Misc. No.54785 of 2017 (2) dt.16-11-2017 3/3 in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
