.... .... Respondent/s =========================================================== Appearance :

For the Petitioner/s : Mr. Kamla Kant Pandey, Adv. For the Respondent/s : Mr. Indradeo Prasad, SC28 =========================================================== CORAM: HONOURABLE MR. JUSTICE JYOTI SARAN ORAL JUDGMENT Date: 16-12-2016 Heard learned counsel for the parties.

Considering that the revision application of the petitioner was dismissed for default and even the restoration application has been dismissed in absence of reasons which would justify the cause, this Court for the ends of justice would feel persuaded to grant one more opportunity to the petitioner to press his revision with the word of caution that the petitioner should be more vigilant on his revision and not allow this opportunity to whittle away.

Having heard learned counsel for the parties and for the reasons so expressed, the order dated 14.11.2014 passed by the Principal Secretary, Forest and Environment Department, Government of Bihar

Patna High Court CWJC No.18621 of 2015 dt.16-12-2016 2/2 in Revision Case No. 3 of 2014 together with the order dated 26.6.2015 passed in restoration application No. 1 of 2015 by the same authority, is quashed and set aside. As a consequence the Revision Case No. 3 of 2014 is restored to its file.

The petitioner should present himself before the Revisional Authority on 6.1.2017 along with a copy of this order and would continue to do so on each date so fixed by the Revisional Authority without any default in appearance and whereupon let the revision be considered on merits and be disposed of by the Appellate Authority in accordance with law.

The writ petition is allowed.
