Petitioner seeks bail in a case registered under sections 272, 273 of the Indian Penal Code as well as section 47(A) of the Excise Act.

In huge quantity country made liquors were recovered but said recovery was neither made from the conscious possession of the petitioner nor from his house. The name of the petitioner was disclosed by two persons who were caught on the spot. No doubt, petitioner does have criminal antecedent of cases of similar nature but taking into consideration the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Umesh Ray, Judicial Magistrate, Ist Class, Aurangabad in NTPC P.S. Case no.
