Petitioners seek bail in a case registered under sections 364, 302, 201/34 of the Indian Penal Code.
No doubt, petitioners are named in the first information report but only suspicion has been raised against them on account of previous enmity and so-called threatening given by petitioners and others.
The impugned order reveals that in course of investigation witnesses claimed that when the deceased went to his mother, deceased had disclosed that petitioners and other FIR named accused persons were calling him but he refused to go with them. No doubt, dead body was recovered from a ditch and some

No.12104 of 2016 (2) dt.29-03-2016 injuries were found on his person but taking into consideration the aforesaid facts and circumstances as well as submissions of the parties, particularly, keeping in mind that except suspicion, there appears to be nothing against the petitioners, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Biraul (Darbhanga) in Kusheshwar Asthan P.S. Case no. 279/2015.
